About the Position: Serves as an attorney for the Base Realignment and Closure (BRAC) Division within the Office of the Deputy Chief of Staff, G9 (Installations) with responsibility for accomplishing and managing diversified legal work pertaining to Army environmental compliance matters arising under environmental and real property statutes including base closure laws throughout the US.

Responsibilities

  • Review documents generated under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Resources Conservation and Recovery Act (RCRA).
  • Compliance documents associated with the National Environmental Policy Act, the National Historic Preservation Act, and other federal environmental regulations.
  • Ensures proper performance of environmental due diligence for transferring property in accordance with Army and DoD policy.
  • Reviews Environmental Condition of Property reports, and counsels the BRAC Division concerning environmental liability in real estate transactions.
  • Review documents and draft memoranda in support of the BRAC mission of transferring property, including Findings of Suitability to Lease or Transfer, leases, deeds, easements, and other property outgrant instruments.
  • Represent BRAC Division interests in communications with external stakeholders including federal and state regulators, community representatives, including members of Congress, and Local Reuse Authority counsel.
  • Represent BRAC Division interests within the Army and to external federal agencies such as the EPA, GSA, FWS, DOI, BLM, and NPS.
  • Monitors environmental initiatives undertaken by the various Army commands and offices and DoD departments to ensure any precedents that are established will not adversely affect the DCS-G9 mission.
  • Develop, advise, and/or assist the BRAC Division, the Army Environmental Law Division, and the Army Office of General Counsel in developing policies and procedures to implement environmental laws, regulations, and directives.
  • Represent the Command on matters involving environmental law issues which cannot be resolved at lower command levels.
  • Confers with and advises other attorneys within the BRAC Division, the Environmental Law Division, and the field and in other agencies concerning environmental law and Army policy and the implementation of agency policy.

Applicants will be evaluated to determine if they meet the minimum qualification requirements and on the extent to which their application shows possession of the following knowledge, skills, and abilities (KSAs) associated with the position:

1) Skill in identifying legal issues and conducting relevant legal research within environmental law, especially CERCLA, RCRA, and NEPA, and environmental aspects of real property law.

(2) Skill in researching and analyzing federal and state environmental requirements. .

(3) Skill in oral and written advocacy, and to support advocacy positions with scientific data.

(4) Ability to effectively, professionally, and ethically manage a heavy caseload of clients with complex legal needs.

B) Experience providing legal advice and counsel to senior officials/heads of large organizations (to include military commanding officers) based upon those Agency administrative regulations, statutes, Executive Orders, and executive branch regulations.

C) Experience in the field of Administrative Law, which includes advising clients on precedent-setting legal matters as they pertain to Agency Regulations and making authoritative substantive recommendations that impact Agency operations.

D) Resolving legal and practical issues surrounding Agency regulations, ensuring that legal concerns are expeditiously addressed and resolved.

E) Experience reviewing policies, procedures, and administrative regulations to ensure they are consistent with the intent of the foundational statute(s) and are administratively sound, efficient, and economical in operation.

VETERANS PREFERENCE INFORMATION: There is no formal rating system for applying veteran''s preference to attorney appointments in the excepted service; however, the Department of the Army considers veteran''s preference eligibility a positive factor for attorney hiring. TIME-IN-GRADE REQUIREMENTS: If currently employed as an attorney by the Federal Government must have completed 52 weeks at the next lower grade level within 30 days of the closing date of the announcement, or previously served at the same or higher grade as the position being filled. Time-in-grade may be waived for current federal employees at management''s discretion.

The following minimum qualification requirements must be met before applicants are eligible for further consideration:

Education: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).

Bar membership: Applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. Document should be dated within three months of the date the application is submitted.

Experience: Applicant must have 3 years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position.

Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as a Master of Laws (LLM) may substitute for one year of the required professional legal experience.
